Terms of Service

By downloading, accessing, or using Doodle Magic ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Age Requirements & Parental Consent

You must be at least 13 years old to use the App. If you are under 13, a parent or legal guardian must accept these Terms on your behalf and is responsible for your usage of the App, including any purchases made through your account.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes. You may not:

  • Copy, modify, distribute, or create derivative works of the App.
  • Reverse-engineer, decompile, or attempt to extract the source code.
  • Use the App for any commercial purpose without prior written consent.
  • Sublicense, lease, or rent access to the App to any third party.

3. User Content & Ownership

You own your doodles. You retain full ownership and intellectual property rights over all images you upload or create within the App.

By using the App, you grant us a limited, non-exclusive license to process your images solely for the purpose of generating the artwork you request. This license terminates when the processing is complete.

The resulting generated artwork is provided to you for personal use. You may save, share, and print your generated artwork for non-commercial purposes. Commercial use of generated artwork requires explicit written permission. Ordering prints or 3D figures through the App is considered personal use and is permitted under these Terms.

4. Account, Credits & Tokens

  • Account Creation: Some features require signing in via Apple Sign-In or Google. You are responsible for maintaining the security of your account.
  • Magic Credits: Used to generate artwork in various styles. Free users receive a starter allocation. Additional credits can be purchased.
  • 3D Tokens: Used to generate 3D figurine models. Available through purchase or premium subscription.
  • No Transfer: Credits and tokens are non-transferable between accounts and have no cash value.
  • Non-Refundable After Use: Once a credit or token is consumed to generate content or start processing, it is non-refundable, except where required by applicable law.
  • No Expiration: Credits and tokens do not expire unless your account is terminated for violations of these Terms.

5. Digital Content & Right of Withdrawal

When you use credits or tokens to generate content, the digital service is performed immediately upon consumption. You acknowledge that the right of withdrawal does not apply once processing has started, as the service is considered fully performed at that point. This does not affect any mandatory refund rights provided by applicable law (including EU consumer protection regulations).

6. Subscriptions & Payments

  • Premium Subscription: Provides access to premium styles, additional monthly credits, 3D tokens, watermark-free exports, and animation features.
  • Billing: All subscription payments and credit/token purchases are processed by Apple through the App Store. We do not store or have access to your payment card information for these transactions.
  • Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage subscriptions in your Apple ID settings.
  • Refunds: Refund requests for subscriptions and in-app purchases must be directed to Apple Support in accordance with App Store policies.

7. Physical Products

Orders for 3D figures and prints are processed separately through Stripe.

  • Made-to-Order: All physical products are personalized and made-to-order based on your generated artwork. Once production has started, cancellation or return is not possible.
  • Defects & Damage: If your order arrives damaged, defective, or incorrect, please contact us within 14 days of delivery at info@doodlemagic.co with your order number and photos of the issue. We will arrange a replacement or refund as appropriate.
  • Delivery Timelines: Estimated production and delivery times are provided at checkout. These are estimates and not guaranteed delivery dates.

8. Prohibited Conduct

You agree not to use the App to:

  • Generate content that is harmful, abusive, threatening, defamatory, or illegal.
  • Create explicit, sexually suggestive, or violent imagery.
  • Upload content that infringes on third-party intellectual property rights.
  • Attempt to circumvent usage limits, security measures, or payment systems.
  • Use automated tools, bots, or scripts to interact with the App.
  • Interfere with or disrupt the App's infrastructure or other users' experience.

We reserve the right to suspend or terminate accounts that violate these terms, without prior notice or refund.

9. Abuse, Fraud & Chargebacks

We may immediately suspend or terminate your account if we detect fraud, abuse, use of automation to circumvent limits, or the initiation of unjustified chargebacks. In such cases, any remaining credits and tokens in your account may be voided, to the extent permitted by applicable law.

10. AI-Generated Content & Limitations

The App uses artificial intelligence (AI) technology to generate images. Please be aware that:

  • Generated outputs can be unpredictable and may not always match your expectations.
  • Generation quality and speed may vary depending on server load and complexity.
  • We apply content filters to promote safe results, but no system is perfect.
  • We do not guarantee the uniqueness of generated artwork. Similar or identical outputs may be produced for other users using similar inputs.

11. Intellectual Property

All rights, title, and interest in the App (including but not limited to design, code, UI, brand assets, style prompts, and technology integration) are owned by Doodle Magic. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Doodle Magic and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from or related to your use of the App. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Doodle Magic and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

15. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your license to use the App ceases immediately. Sections on intellectual property, limitation of liability, indemnification, and governing law survive termination.

16. Apple-Specific Terms

Apple Inc. is not a party to these Terms and has no obligation to furnish any maintenance or support services with respect to the App. Any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property claims, should be directed to the operator (see Section 0), not to Apple, except as required by applicable law.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notification or a notice on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Any disputes shall be resolved in the competent courts of Germany, unless your local consumer law requires otherwise.
